AJLS专辑征稿启事 | 亚洲法院与治理

【内容提要】


经与季卫东教授(《亚洲法与社会杂志》主编、上海交通大学文科资深教授、上海交通大学中国法与社会研究院院长)达成共识,香港大学贺欣教授将担任此次AJLS专辑(预计于2027年出版)的客座主编。AJLS是一份广受盛誉的知名刊物,为全球法律与社会学术研究提供了日益重要的亚洲视角。刊物采用同行评审制度,以实证研究与跨学科研究为特色,并通过对法律与社会议题的比较型探索,为全球关注的社会-法律问题提供独特视角。


此次专辑以“亚洲法院与治理”为主题。法院通常被理想化为无偏私的正义裁决者和宪法秩序的守护者,这种观点在西方自由民主国家尤为盛行。然而,在亚洲这样一个具有不同法律传统、历史遗产和政治制度的地区,法院在治理中发挥着不同而复杂的作用。本专辑试图通过研究亚洲法院如何驾驭、塑造并被治理结构所塑造,来挑战关于司法独立、权利发展和法院职能的欧洲中心主义假设。


我们诚邀原创性实证研究,探讨亚洲各司法辖区法院的独特职能、制约因素和态势。投稿应批判性地探讨决定该地区司法行为、权利实施和更广泛的法治的政治、历史和社会法律背景。


征稿主题


我们欢迎关于但不限于以下主题的投稿:

Ø  司法独立和制约因素

Ø  比较视角下的权利发展

Ø  作为治理行动者的法院

Ø 司法程序中的行动者和机构

Ø  案件处理与司法行为


采用广义意义上的实证方法的研究将被优先考虑。鉴于亚洲各地区的历史和政治背景迥然不同,本专辑特别欢迎那些突出亚洲法院和参与者独特视角的研究。

在考虑投稿以及提交相关材料时,请注意如下事项:

Ø 我们欢迎使用实证和其他方法进行社会法律研究的实证研究文章

Ø 论文选题需要与亚洲背景下的法院相关问题紧密相关

Ø  鼓励与来自亚洲国家与社会的学者展开合作

Ø 所有最终入选稿件都将经过同行评审

Call for Papers

Special Issue on Courts andGovernance in Asia

Per agreement with Professor Ji Weidong (Shanghai JiaoTong University, China, Editor-in-chief of AJLS), Prof. Xin He of The University of Hong Kong is serving as guest editor for an Asian Journal of Law andSociety special issue (to be published in 2027). AJLS is a reputable journal thatprovides an increasingly important Asian perspective to global law and societyscholarship. AJLS peer-reviewed publications feature empiricaland multi-disciplinary research and bring a unique perspective to socio-legalissues of global concerns with a comparative exploration of law and societytopics.

Courts areoften idealized as impartial arbiters of justice and guardians ofconstitutional order, particularly in Western liberal democracies. However, inAsia—a region marked by diverse legal traditions, historical legacies, andpolitical systems—judiciaries play varied and complex roles in governance. Thisspecial issue seeks to challenge Eurocentric assumptions aboutjudicial independence, rights developments, and court functions by examininghow courts in Asia navigate, shape, and are shaped by governancestructures.

Weinvite original empirical research that explores the uniquefunctions, constraints, and dynamics of courtsacross Asian jurisdictions. Contributions should critically engage withthe political, historical, and socio-legal contexts that definejudicial behavior, rights enforcement, and the broader rule of law in theregion.

Topics of Interest:

We welcomesubmissions on, but not limited to, the following themes:

· Judicial Independence and Constraints

· Rights Developments in Comparative Perspective

· Courts as Governance Actors

· Actors and Institutions in the Judicial Process

· Case Processing and Judicial Behavior

Priorities will be given to studies that employ empiricalmethods, broadly defined. This special volume particularly welcomes researchworks that highlight the unique perspectives on courts and the participants inAsian countries, which are situated in a context with quite differenthistorical and political contexts.

Please keep in mind the following in your considerationand submission:


  • We welcome empirical research articles using empirical and other methods for social-legal studies


  • The topic of the thesis should be closely related to the relevant issues of courts in the Asian contexts


  • Preferences will be given to broad coverage of Asia, including all regions and areas


  • collaboration with scholars from Asian nations and societies would be welcome


  • All finally selected manuscripts will undergo peer review

This special volume of AJLS will beedited by Prof. Xin He of The University of Hong Kong. Manuscripts should besubmitted directly to the editor (xfhe@hku.hk) in MS WORD format.

Manuscripts should represent unpublished original work.If you are potentially interested in contributing to this special issue, pleasesend us via email:

(1) a proposed title of your manuscript, and (2) anabstract (150 words) by 31 July 2025. The deadline for submissionsof the full manuscript is 31 May 2026, and the projectedpublication is early 2027.
