At the invitation of United NationsUniversity Macau AI Conference 2025, the Computational Law Association of ChinaComputer Federation and the China Institute for Socio-Legal Studies of ShanghaiJiao Tong University will chair a special session on October 24, 2025, titled"How Can AI Promote Equity and Justice? Building Institutional Ecosystemsfor AI Judiciary from a Computational Law Perspective". This session willexplore the integration of artificial intelligence in judicial systems to enhancefairness and efficiency, aligning with the conference theme "AI forHumanity: Building an Equitable Digital Future".

Session Description
会议概述
AI technologies are being integrated into judicial systems at an unprecedentedpace, from sentencing prediction and case allocation to evidence analysis.However, this technological empowerment is accompanied by structuralcontradictions, such as tensions between efficiency and fairness, opacity ofalgorithmic systems versus institutional transparency, and conflicts inmultistakeholder governance. This session will address the core question: howcan AI advance equity and justice while being embedded in judicial processes?Discussions will focus on collaborative configurations of judicial authority,governance frameworks for judicial technologies, and innovative rules forcross-border AI-assisted judicial cooperation. The session aims to resolveparadoxes in judicial AI adoption, drive paradigm shifts in digital justice,and foster transnational collaboration in AI-enabled judicial systems.

人工智能技术正以前所未有的速度融入司法领域,从量刑预测、案件分配到证据分析。然而,这种技术赋能也伴随着结构性矛盾,例如效率与公正的张力、算法系统的不透明性与制度透明度的对立,以及多元治理中的冲突。本环节将探讨核心问题:AI在融入司法领域时如何促进公平正义?讨论将聚焦于司法权力的协同配置、司法技术的治理框架以及跨境人工智能司法协作的创新规则。旨在破解司法智能化悖论、推动数字正义范式转型、促进跨国AI司法系统合作。

Chairing the session will be ProfessorWeidong Ji, University Professor of Liberal Arts and Social Sciences, Presidentof China Institute for Socio-Legal Studies, and Director of Center for AIGovernance and Law at Shanghai Jiao Tong University. He will be joined by threedistinguished speakers in the following order:

本次会议由上海交通大学文科资深教授、中国法与社会研究院院长、人工智能治理与法律研究中心主任季卫东教授主持。与会嘉宾按发言顺序包括:

  • Professor Jinhua Cheng (Vice President of China Institute for Socio-Legal Studies, and Director of the Empirical Legal Studies Center at Shanghai Jiao Tong University) will present survey-based findings on public imaginaries of AI in smart courts. His research reveals that while public support for AI in judicial work is generally positive, it varies significantly across professional groups, with non-legal professionals showing higher optimism. The study underscores the co-production of judicial credibility and AI integration, where trust in judiciary enhances support for AI applications.

程金华教授(上海交通大学中国法与社会研究院副院长、法律实证研究中心主任)将基于民意调查,分享公众对智能法院中AI应用的想象。研究发现,公众对AI在司法工作中的支持总体积极,但不同职业群体差异显著,非法律专业人士更为乐观。研究强调司法公信力与AI应用的协同生产,即司法信任促进对AI的支持。

  • Professor Xifen Lin (Vice Dean of Koguan School of Law at Shanghai Jiao Tong University, and Secretary-General of the CCF Committee on Computational Law) will share insights from cognitive experiments on AI's impact on judicial credibility. Through experiments involving trademark cases, his work demonstrates that public identification with court rulings is high (60.55% consistency), but AI intervention can cause interference. He emphasizes the need for bidirectional synergy between the public, judges, and AI to mitigate risks.

林喜芬教授(上海交通大学凯原法学院副院长、CCF计算法学分会秘书长)将通过认知实验研究成果,探讨AI对司法公信力的影响。基于商标案例的实验显示,民众对法院判决的认同度较高(一致性均值60.55%),但AI介入可能产生干扰。他强调构建民众-AI”法官-AI”的双向协同以降低风险。

  • Associate Professor Yaokun Qiu (Koguan School of Law at Shanghai Jiao Tong University, and Secretary-General of the Law Society for Social Issues of the Shanghai Law Society) will discuss the double-edged role of video generation models like Sora in smart courts. He highlights opportunities such as vivid fact restoration and optimized rulings, but also warns of risks like technological dependency and "black box" opacity. He proposes judge-led approaches, moderate explanations, and manual reviews to balance efficiency and fairness.

邱遥堃副教授(上海交通大学凯原法学院、上海市法学会法社会学会秘书长)将分析视频生成模型(如Sora)在智能法院中的双刃剑作用。他指出机遇包括生动还原案件事实和优化审判,但也警示技术依赖和黑箱风险。主张以法官为主导,通过适度解释和人工审查平衡效率与公平。

  • Professor Weidong Ji will conclude by examining legal argumentation in the AI era. He argues that while AI can assist logical reasoning, it may hollow out legal interpretation without expert supervision. He calls for building value judgment systems through topic catalogues and communication protocols to ensure AI complements human discretion.

季卫东教授将总结AI时代的法律论证。他指出AI可辅助逻辑推理,但缺乏专家干预可能空心化法律解释。呼吁通过主题目录和沟通协议构建价值判断系统,确保AI补充人类裁量。
